 BioMedLib privacy policy, and terms of use 
This document explains terms and conditions for using the BioMedLib™ Service ("BML™ Service"). Some of the conditions are required by National Library of Medicine (NLM®), from which the MEDLINE® database is leased.

By using the BML™ Service, you agree to the following terms and conditions ("Terms of Use") as changed from time to time by updated postings at the BML™ Service site. BML™ may from time to time change the services provided by the BML™ Service or the Terms of Use, without prior notice and without liability. Users should carefully review the Terms of Use before using the BML™ Service, and thereafter from time to time in order to know about any changes. Do not use the BML™ Service if you do not agree to the Terms of Use, or if you don't have status to legally be bound by this document..


1. Source of Information
The search results, links, and other information provided to you when you use the BML™ Service are derived from databases of information provided by the US National Library of Medicine (NLM®) and MEDLINE® under license to the BML™ and are produced by automatic equipment, computers, and software. Search results, links, and other information are neither viewed nor screened by human beings or otherwise before users see them and some users might consider information to be offensive, objectionable, or otherwise inappropriate. BML™ is not responsible for the content of or the links at any site included in any search results. BML™ will endeavor to address allegations of alleged infringement that comply with the Digital Millennium Copyright Act.

2. Non-Commercial Use
The BML™ Service is provided without charge and is solely for personal and non-commercial use and may not be used to sell products or services or to increase Internet traffic to another site for commercial purposes. The BML™ Service search results may not be reformatted and redisplayed or mirrored at another site using frames or otherwise. No metasearching using the BML™ Service is permitted. You may request permission for commercial use of the BML™ Service by contacting BML™ and setting forth in detail the nature of your proposed use.

3. Privacy Policy
The BML™ Service does not collect personal information about you when you visit The BML™ Service Web site unless you choose unilaterally to provide that information.

When you visit The BML™ Service Web site, The BML™ Service may store some or all of the following: the Internet address from which you access the Web site and the date and time of your visits, the Internet address of the web site from which you linked to The BML™ Service's Web site, the name of the file or words you searched, the items clicked on a page, and the browser and operating system used.
This information is used to measure the number of visitors to the various sections of the Web site and to identify system performance or problem areas, and to help expand the coverage of the Web site, to analyze patterns of usage, and to make the Web site more useful.
However, this information is not used for associating search terms or patterns of site navigation with individual users. The BML™ Service periodically purges the Web site's Web logs.

If you choose to provide The BML™ Service with personal information by sending an email, or by filling out a Feedback form with your personal information and submitting it through The BML™ Service Web site, that information will be used to respond to your message and to help The BML™ Service provide you with the information or material that you request.
If provided, personally identifiable information is maintained in a database that is regularly purged. The BML™ Service does not give, share, sell, or transfer any personal information to a third party unless required by law.

The BML™ Service provides information from other websites including the NLM Web Sites. The NLM Web sites, such as MedlinePlus, provide links to other Internet sites that provide information. Once you link to and once you visit another site, you are subject to the privacy policy of the new site.

BML sites also feature ads from third parties ("Advertisers"); when you click on an ad, you will be leaving the BML network of sites and will be redirected to the Advertiser's site and subject to the policies of that Advertiser. It should be clear to you when either of these site transfers occur as the "look and feel" of your web page will change, and the URL will no longer refer to the url of a BML site. This Privacy Policy does not govern the use of, or disclosure of any information you choose to disclose to the Advertiser or Content Sponsor on, the Advertiser or Content Sponsor site.

We use electronic images known as "clear GIFs" (sometimes called "transparent GIFs", "Web bugs", "pixel tags" or "beacons") that allow us to track general user traffic patterns.

Use and Disclosure of Information We Collect: We use Member Information to deliver email newsletters on topics of interest to Members who have requested those services. We may also send general promotional and marketing materials to our Members, including marketing research surveys. BML, in some cases utilizing a third party provider, deploys surveys and incentives. We use Member Information in aggregated form to understand our customer base and to market our services to our customers.

Disclosure of Aggregated Information: We provide summary reports to our Sponsors, based on our analysis of server log data. This information is aggregated and does not disclose any Member Information to the Sponsors.

Transaction Information: We use this information to complete the transaction that you have requested, i.e. to deliver information, products or other services that you order and to invoice you. We do not store your credit card information.

How Can You Opt Out: Following the registration process, we also allow Users the option to opt-out of receiving emails from BML. Users who opt-in may also remove themselves from emailing lists at any time through the edit profile pages or by following the instructions at the end of any email they received from BML.
If you do not want to receive future communications from BML, please contact us at custserv@bmljournal.com and we will deactivate your membership.

Security: BML has implemented reasonable security measures to protect information from loss, misuse and unauthorized access, disclosure, alteration or destruction. Our security systems include authenticated access to internal databases, audits of procedures, and regular reviews of overall Web security.

Access and Updating of Information: The instructions to review, amend, or delete your information may be found in the edit profile area on any of our sites. Users may change information at any time and as often as necessary. Users who are experiencing problems with our services or who have questions about how our services work can contact us by sending an email to: custserv@bmljournal.com.

Registration Password: Your Member Information is password-protected to control access to this profile information by third parties. However the default password is blank, unless you add a password; Please use the page http://wipimd.com/?&wft=wims&flnm2=w3ips.html to add or change your password. We recommend that you do not divulge your password to anyone. BML never asks for passwords in unsolicited phone calls or unsolicited emails.

Links: The network of BML sites contains links to other Web sites. BML is not responsible for the privacy practices or the content of those sites. Users should be aware of this when they leave our Sites and review the privacy statements of each Web site they visit that collects information. This Privacy Policy applies solely to information collected by the BML network of Sites.

Business Transfers: We are always seeking to improve our network of Web sites and our business. If all or part of BML is sold, merged or otherwise transferred to another entity, the Member Information and data may be transferred as part of that transaction.

Amendments: BML may from time to time change the terms of this Privacy Policy without prior notice and without liability. If you object to any of the changes, you can have us delete your information from our database by contacting custserv@bmljournal.com.

Options: Users who would rather not provide any of the user data requested by our registration process do not need to register with us. You can still view much of the content and use many of the services offered by our Sites without registering.
Note: If you choose not to provide certain Member Information when registering for a site, certain products or services may not be available to you.

Enforcement: If you believe that BML has not complied with this Privacy Policy, or if you have any other complaint with regard to collection, use or disclosure of information by BML, you may send a written notice of complaint to: BioMedLib LLC,

SOME STATES OR OTHER JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES AND THEREFORE SOME EXCLUSIONS IN THE TERMS OF USE MAY NOT APPLY TO ALL USERS. USERS MAY ALSO HAVE OTHER RIGHTS AND REMEDIES THAT VARY FROM STATE TO STATE AND JURISDICTION TO JURISDICTION.

BioMedLib LLC reserves the right to discontinue products and to change specifications at any time without incurring any obligation to incorporate new features in products previously sold.


5. Force Majeure
BML™ shall never be responsible nor liable for any delay or failure in performance resulting directly or indirectly from acts of nature, or forces or causes beyond the BML™'s reasonable control, including Internet or World Wide Web failures, computer hardware or software failures, telecommunication equipment or other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, terrorism, epidemics or pandemics, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions or inactions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning, or for any other causes, acts, or omissions beyond the reasonable control of the BML™.

6. Commonwealth of Virginia
The Terms of Use will be governed by and construed in accordance with the law of the Commonwealth of Virginia, without giving effect to conflict of laws provisions of any user's state or country or other jurisdiction of location or residence, as applied to transactions taking place wholly within the Commonwealth of Virginia between residents of the Commonwealth of Virginia. The courts of the Commonwealth of Virginia shall be the sole and exclusive judicial forum and venue for and in connection with any litigation arising out of or relating to the BML™ Service, BML™, and the Terms of Use, and users relinquish any right or entitlement to invoke federal diversity jurisdiction in connection with any such litigation. If for any reason a court of competent jurisdiction finds any provision or portion of the Terms of Use to be unenforceable, the remainder of the Terms of Use will continue in full force and effect.

7. Quality assurance
Consistent with the provisions of the license agreement between BML™ and the National Library of Medicine, the BML™ Service is provided in accordance with the following quality assurance features:
  • The BML™ Service adds new records to the database at least as frequently as quarterly. However, usually the BML™ database is updated on a daily basis.
  • The BML™ Service corrects records at the time new records are added at least as frequently as quarterly.
  • The BML™ Service has an "announcement page", for significant errata and/or retractions identified by NLM.
  • The BML™ Service performs annual class maintenance on the records.
  • The BML™ Service announces that source for all records is NLM's MEDLINE.
  • MEDLINE® and NLM® are registered trademark of the U.S. National Library of Medicine.
  • The BML™ Service can be accessed by any web browser (including Internet Explorer, Netscape, FireFox, and Opera), on any computer connected to World-Wide-Web. Further explanation is in the BML™ Service website.
  • The content, capabilities, and purpose of the BML™ Service is explained in its website.
  • For questions regarding NLM's MEDLINE database, or PubMed search engine, please refer to NCBI contact page at URL http://www.ncbi.nih.gov/About/glance/contact_info.html, and PubMed help desk at URL http://www.nlm.nih.gov/contacts/contact_pubmed.html. For questions about BML™, please contact custserv@blmsearch.com .

The BML™ Service displays several fields containing content, among which are these nine specifically NLM-required fields:
  • AuthorList = Author(s) - includes collective name
  • PubDate = Date of publication
  • DateRevised = Date record last revised
  • Pagination = Pagination
  • MedlineTA = Journal title abbreviation
  • ArticleTitle = Title of article
  • PMID = Unique identifier
  • Volume = Volume/Issue
  • Comments/Corrections = Reference to commentary, erratum, retraction, etc.

Also, BML™ complies with NLM requirement for the following five fields to be searchable.
  • AuthorList = Author(s) - includes collective name
  • DateRevised = Date record last revised
  • MedlineTA = Journal title abbreviation
  • ArticleTitle = Title of article
  • PMID = Unique identifier
  • Abstract
  • MeSH

8. Other regulations
